On September 5, 2008, Austin Student (Student ID 888000099) and Lea Pupil (Student ID 456000078) were each caught having in their possession one ounce of marijuana. As required, the local law enforcement agency was called in to corroborate/confirm the administrator’s belief that the two students were in possession of Marijuana and it was confirmed. Neither student is in special education. Because their continued presence at school did not create a safety threat for other students, they were placed in ISS pending the conference meeting to place them in the local DAEP. On September 8, 2008, two conference meetings were held (one for each student and their parents) to provide the “due process” requirements for a behavior that requires a mandatory DAEP placement. As a result of each conference meeting, the boys were assigned to the district Off-Campus DAEP located at campus number 003 for 30 school days. After 20 days in the DAEP, Lea Pupil withdrew from school and moved to another Texas school district (ABC ISD 888888) and on October 10, 2008 enrolled in school and was required by ABC ISD high school (002) to complete the unfinished DAEP assignment at the On-Campus DAEP.
