425 DISCIPLINARY ACTION DATA - STUDENT

On October 1, 2008, during the second six weeks of the school year, Anne Example, who is 18 years old and attends a school in a county which is required to operate a JJAEP, retaliated against a teacher by setting the teacher’s car on fire. As required, the local law enforcement agency was called in to corroborate/confirm the administrator’s belief that retaliation against a teacher coupled with arson had occurred and it was confirmed. Because her presence at school was deemed to be a safety threat she was immediately suspended out of school for three days. On October 6, 2008, during the third six weeks of the school year after Anne’s three-day OSS, an expulsion hearing was convened to provide the “due process” requirements for a behavior that requires an expulsion. At the expulsion hearing attended by Anne and her parents, the events of the offense were reviewed and according to the requirements of state law, it was determined that Anne must be expelled. The term of expulsion was determined to be 90 days. Because the district is located in a county that is required to operate a JJAEP the expulsion order was sent to the juvenile court where they immediately referred Anne Example to the county JJAEP and Anne was immediately enrolled in the JJAEP.
