425 DISCIPLINARY ACTION DATA - STUDENT

On December 1, 2008, Art Student, who is 15 years old and attends a school in a county, which is required to operate a JJAEP, attempted to murder Mr. Instructor, the principal, but only wounded the principal in the arm. As required, the local law enforcement agency was called in to corroborate/confirm the administrator’s belief that criminal attempt to commit murder had occurred and that a firearm had been brought to school and it was confirmed. Because Art’s continued presence at school created a situation of “eminent harm” an emergency expulsion was ordered for this Art until the district could conduct a “due process” expulsion hearing as required under state law. Art was arrested and taken to a Juvenile Detention Center. On December 20, 2008, after Mr. Instructor returned from a short stay in the hospital, an expulsion hearing was convened to provide the “due process” requirements for a behavior that requires an expulsion. At the expulsion hearing, attended only by Art’s parents since Art was still in the Juvenile Detention Center, the events of the offense were reviewed and according to the requirements of state law, it was determined that Art must be expelled for attempted murder. The term of expulsion was determined to be 180 days. Because the district is located in a county that is required to operate a JJAEP the expulsion order was sent to the juvenile court where they immediately referred Art to the county JJAEP. Because Art is still in jail, he cannot be enrolled in the JJAEP until such time that he is released. Art never returned to school. A speedy trial was held and Art was convicted of attempted murder and sentenced to the nearest Texas Youth Commission facility to serve his term of sentence.
