Overview
As a result of the 2004 amendments to the Individuals with Disabilities Education
Act (IDEA2004), all states must ensure that the state has on file with the Secretary
of the U.S. Department of Education assurances that the state meets or will
meet all of the eligibility requirements of Part B of the IDEA as amended in
2004 by Public Law 108-446. A state may do this by one of the following methods:
(1) provide assurances in the Part B State Application that it has in effect
policies and procedures to meet the requirements of Part B of the IDEA as amended
in 2004 by Public Law 108-446; (2) provide assurances in the State Application
that the state will operate consistent with all the requirements of Public Law
108-446 and applicable regulations and make such changes to existing policies
and procedures as are necessary to bring those policies and procedures into
compliance with the requirements of IDEA, as amended; or (3) submit modifications
to state policies and procedures previously submitted to the U.S. Department
of Education.
In order to meet the requirements of Section 612 of the Individuals with Disabilities Education Act (IDEA 2004), the State of Texas has developed policies and procedures as outlined in the “State Eligibility Document:/State Policies and Procedures” listing Texas statutes and rules as they address corresponding federal regulations, as well as links to additional related information.
The document contains the Federal Requirements, Texas Administrative Code (TAC), Texas Education Code (TEC), and Regional Education Service Centers (ESC) programs and projects included as examples of how the state of Texas implements federal requirements.

- In order for the state of Texas to receive its Individuals with Disabilities
Education Act (IDEA) Part B grant funds each federal fiscal year, the Texas
Education Agency (TEA) must complete an application packet and submit it to
the US Department of Education Office of Special Education Programs (OSEP).
