The federal guidance document relating to students with disabilities placed by their parents in private schools provides vaulable implementation information for parents and school personnel regarding a district's obligation to eligible students in private schools. However, please remember, this guidance document reflects only the federal requirements/process and does not include the Texas provisions of dual enrollment.
Parents and school personnel should refer to current state statute and State Board of Education and commissioner rules to ensure that the Texas process relating to services for students with disabilities placed by their parents in private schools is implemented.
Note: The TEA has developed a technical assistance document on this subject in response to the OSEP Q & A. This document provides a Texas perspective to the issue of students with disabilities in private schools.
