TO THE DISTRICT PEIMS COORDINATOR ADDRESSED:

SUBJECT: Verification of Accuracy of PEIMS 425 Record for School Year 1999-2000

This letter is to bring to your attention serious concerns regarding the accuracy of data reported in the PEIMS 425 Record for school year 1999-2000. Chapter 37 of the Texas Education Code (TEC) requires the Texas Education Agency (TEA) to collect very specific data regarding disciplinary placements. Specific mandated actions are required for certain student conduct violations specified in TEC §37.006 and §37.007.

Attached is a report that includes information regarding specific student PEIMS 425 data submitted by your district. The attached report includes data that appears to raise issues of compliance with state law. The information in this report needs to be reviewed and corrected if necessary. Specifically, review the disciplinary reason and action codes you have used for mandatory Disciplinary Alternative Education Program (DAEP) placements and expulsions. Please note that the attached report does not include your complete PEIMS 425 Record.

The May 22, 2000 'TO THE ADMINISTRATOR ADDRESSED' letter explained several specific areas of concern with the PEIMS 425 Record submissions. Please refer to that letter as a resource as you review the attached report. The areas of concern include but are not limited to:

  • The mandatory assignment to a DAEP of any student who commits certain criminal violations on campus or a Penal Code Title 5 felony off the school campus as stated in TEC §37.006.
  • The mandatory expulsion of any student who committed certain criminal violations on the school campus as stated in TEC §37.007.
  • The use of code 99 ('other') as a reason or action code should only be used for those rare instances when no other code applies. To this date, no circumstances have been identified that would warrant the use of code 99 as a disciplinary reason or action. Please refer to the requirements of TEC §37.001 and the PEIMS Data Standards Code Tables C0164 (Disciplinary Action Codes) and C0165 (Disciplinary Action Reason Codes) for the appropriate codes that should be used in lieu of code 99.

Please review the attached report and your PEIMS 425 Record for school year 1999-2000 and make the necessary corrections to ensure accurate reporting on the final submission (July 27, 2000). The TEA may require a written explanation for each action reported on the PEIMS 425 Record not in compliance with TEC §37.006 and §37.007.
