November 2, 1999 ESEA Title I, Part A SUBJECT: Annual Survey of Children in Facilities for Neglected or Delinquent Children The Elementary and Secondary Education Act, as amended, Title I, Part A, Improving Basic Programs Operated by Local Educational Agencies (LEAs) stipulates that an LEA's grant will be partially based upon the number of children (ages 5 through 17, inclusive) who have resided in neglected or delinquent facilities for at least 30 consecutive days, of which at least one day was in the month of October 1999. An "Annual Survey of Children in Local Facilities for Neglected or Delinquent Children" (SSP-206) is being transmitted directly to approximately 600 facilities, which are licensed by the Texas Department of Protective and Regulatory Services. The administrator of the facility for the neglected and/or delinquent must complete the survey form and return it to the Division of Student Support Programs at the Texas Education Agency by December 6, 1999, in order to generate funds for providing services to these students residing in facilities for the neglected or delinquent during school year 2000-2001. In order to prevent funds from being returned (lapsing) to the U.S. Department of Treasury, please consider the following:
In the event your local education agency has for-profit or nonprofit facilities for the neglected or delinquent located within its boundaries, you are encouraged to contact the administrators of such facilities to remind them of the importance of submitting the completed survey by the deadline date of December 6, 1999. The caseload count reported on the annual survey generates federal funds. In order to avoid duplication of funds, the caseload reported must not include foster home children under the conservatorship of the Department of Protective and Regulatory Services; these counts generate Title I, Part A funds under the foster home provision. The LEA will be notified in the spring of the counts reported by the neglected or delinquent facilities. When notified, the LEA is responsible for verifying these counts and advising the Texas Education Agency in the event a count is overstated. Texas Education Agency monitoring teams and auditors will be verifying the documentation which supports the number of children residing in the facility for 30 or more consecutive days. Forms are not enclosed with this letter; however, if you know of a facility located within the local education agency's boundaries which did not receive such forms or if you have any questions, please contact Ms. Liz Garrett or Ms. Barbara Johnson in the Division of Student Support Programs at (512) 463-9374.
