TO: THE ADMINISTRATOR ADDRESSED

SUBJECT: Title I, Part A Capital Expense Funds Available to Local Education Agencies Serving Eligible Students Attending Private, Religiously Affiliated Schools

Title I, Part A Capital Expense funds will be available to help LEAs defray the costs of current-year capital expenses incurred in providing Title I, Part A services to students attending private, religiously affiliated schools. A projected total of $487,263 is available for Texas schools to fund these projects. If the level of funding is insufficient to fund all eligible applicants, a ratably reduced share will be granted. These monies must be expended by June 30, 2001.

A complete copy of the required application (RFA #701-00-026) may be obtained by calling (512) 463-9304 or by writing the Document Control Center, Room 6-108, Texas Education Agency, William B. Travis Building, 1701 North Congress Avenue, Austin, TX 78701. The application must be received in the Document Control Center no later than 5:00 p.m. (Central Time), Friday, June 30, 2000, to be considered for funding. Please note that the nature of this application requires strict adherence to this deadline.

The term "capital expenses" refers to expenditures for noninstructional goods and services such as the purchase, lease, rental, and renovation of real and personal property (including but not limited to mobile educational units and leasing of neutral sites or space), insurance and maintenance costs, transportation, costs for the technician supervising computer-assisted instruction (CAI), and other comparable goods and services [Public Law 103-382, Section 1120(e)] that are incurred as a result of implementation of alternative delivery systems to comply with the requirements of Aguilar v. Felton. Additional guidance from the U.S. Department of Education indicates that expenses for security systems (e.g., salary for security guard, security lights, parking, etc.) for mobile education units are also allowable capital expenses. [34 CFR 200.16]

Capital expenses do NOT include the purchase of instructional equipment such as computers. However, if the LEA has used Title I, Part A funds for Capital Expenses items such as those listed above, the LEA may apply to be reimbursed for these items. Because reimbursement funds are replacing Title I, Part A funds that were removed from the instructional program in order to pay for capital expenses, the reimbursement funds should be put back into the instructional program. In this case, requests for instructional equipment, supplies, and services may be included in the application. If funds remain after all requests for current-year capital expenses are met, requests for instructional items will be considered.
