SUBJECT:  2010-2011 Affirmation of Consultation with Private Nonprofit Officials

Local Education Agencies (LEAs) must document the participation or non-participation of Private Nonprofit Schools in regard to receiving equitable services from the federal No Child Left Behind (NCLB) programs. Public school officials are required to complete and submit to the Agency an Affirmation of Consultation with Private Nonprofit School Officials (Affirmation) in the fall of 2010 for the 2010-2011 school year. The form for LEAs to use is now available on the NCLB webpage.

The submittal deadline for the 2010-2011 school year Affirmation is September 30, 2010.

Federal law requires private schools to be contacted annually to determine which schools wish to participate It is the responsibility of the LEA to ensure consultation with the private schools is timely and meaningful. Consultation must occur during the design and development of the programs and before the LEA makes any decisions affecting the opportunities of eligible private school children, teachers, and other educational personnel to participate in the programs. LEAs are required to affirm the consultation has occurred. The instructions and forms for completing the Affirmation of Consultation requirement may be accessed via the Division of NCLB Program Coordination webpage under sample forms at: http://www.tea.state.tx.us/index4.aspx?id=4749&menu_id=798.

If you have any questions regarding the 2010-2011 Affirmation of Consultation with Private Nonprofit Schools requirement, please contact Ms. Heather Mauzé in the Division NCLB Program Coordination, at 512-463-3212, or via email at heather.mauze@tea.state.tx.us.
