ACTION REQUIRED June 17, 2011 TO THE ADMINSTRATOR ADDRESSED: SUBJECT: 2011-2012 Affirmation of Consultation with Private Nonprofit Officials The federal No Child Left Behind (NCLB) Act requires local educational agencies (LEAs) to document the participation or non-participation of private nonprofit schools (PNPs) with regard to receiving equitable services from NCLB programs. LEAs are required to obtain a signed Affirmation of Consultation with Private Nonprofit School Officials (Affirmation) in the fall of 2011 for the 2011-2012 school year. The form for LEAs to use is now available on the NCLB webpage. NCLB statute requires LEAs to consult annually with PNPs to determine which PNPs wish to participate in federal programs. It is the responsibility of the LEA to ensure consultation with the private schools is timely and meaningful and that the consultation occurs during the design and development of the programs and before the LEA makes any decisions affecting the opportunities of eligible private school children, teachers, and other educational personnel to participate in the programs. LEAs are required to affirm the consultation has occurred. The submittal deadline for the 2011-2012 school year Affirmation of Consultation is 5 p.m. CST, Friday, September 30, 2011, anditmust be uploaded through the NCLB Reports application on the TEA Secure Environment (TEASE). If the LEA has participating private, non-profit schools indicated on the PS3101 of the 2011-2012 NCLB Consolidated Application, failure to submit the Equitable Services worksheets by September 30, 2011, may cause the LEA’s Initial Compliance Review (ICR) score in the 2012-2013 NCLB desk audit process and subsequent compliance interventions to be elevated.
