SUBJECT:  Findings Related to Texas’ Implementation of the Title I, Part A Programs Provided to
Private Non-profit Schools; USDE Monitoring Report

The U.S. Department of Education (USDE) conducted a monitoring visit related to the Title I, Part A program under the No Child Left Behind Act (NCLB) in May 2010.  As a result of this visit, the USDE provided the Agency with a report of findings in August 2010.  Several of the findings in this report directly concern the appropriate provision of Title I, Part A services to private non-profit schools:

  • The Agency must ensure that its LEAs provide equitable services to participating private school children in a timely manner.
  • The Agency must ensure that its LEAs maintain control of the Title I, Part A program for the participating private school children in their contracts with third-party providers.
  • The Agency must ensure that its LEAs evaluate their Title I, Part A programs for private schools.
  • The Agency must ensure that its LEAs use proper inventory controls in participating private schools.
  • The Agency must ensure that its LEAs exercise proper oversight in awarding contracts for the provision of Title I services to participating private school children.
  • The Agency must ensure that its LEAs calculate the appropriate equitable share to the participating private schools as required by statute.
  • The Agency must ensure that its LEAs perform the proper calculations for equitable services with respect to the required reservations.

In response to these findings, the Agency is revising and re-issuing its guidance documents related to the provision of Title I, Part A services to private, non-profit schools.  Included in this guidance will be an extensive Question and Answer section related to third-party contracts.  LEAs will be notified via the NCLB Updates listserv as soon as the revised documents have been posted to the TEA web site. 

The Agency will review its monitoring processes to ensure that the issues detailed above are appropriately addressed.  This will likely result in additional program implementation questions on the 2010-2011 Consolidated Compliance report for Title I, Part A.

In addition, in order to ensure that LEAs are making the appropriate calculations to determine equitable services amounts, the Agency is requiring that each LEA with participating private, non-profit schools submit documentation concerning the calculation of equitable services amounts.  To facilitate this, the Agency has provided an Equitable Services Worksheet, available on the Agency’s web site at:  http://www.tea.state.tx.us/index4.aspx?id=2147486851&menu_id=798.  The LEA may use this worksheet, or an alternative method for documenting that the appropriate calculations have been made.

The completed worksheets, or a copy of the alternative documentation, are due to the Division of NCLB Program Coordination by November 15, 2010.  If the LEA has participating private, non-profit schools indicated on the PS3101 of the NCLB Consolidated Application, failure to submit the Equitable Services worksheets by November 15, 2010, may cause the LEA’s Initial Compliance Review (ICR) score in the 2011-2012 NCLB desk audit process and subsequent compliance interventions to be elevated.
