Discretionary Expulsion

The Texas boys, Jack and John, were caught drinking alcohol behind Learning Junior High School. The judge assessed no fine because of the boys’ ages. Being minors they cannot be required to pay a fine and because the boys are responsible for their truancy in this case, the parents cannot be forced to pay a fine either. The judge sentenced the boys to community service time. The campus administration conducted an expulsion hearing to expel these students to a DAEP.
