425 DISCIPLINARY ACTION DATA - STUDENTMandatory Expulsion/Non-JJAEP

On June 3, 2011 Rex Learner, who attends a school in a county which is not required to operate a JJAEP, brought a firearm to school in his backpack. Rex is not a special education student. He was immediately suspended out of school for three days. On June 6, 2011, after Rex’s three-day OSS, an expulsion hearing was convened to provide the “due process” requirements for a behavior that requires an expulsion. At the expulsion hearing attended by Rex and his parents, the events of the offense were reviewed and according to the requirements of the law, it was determined that Rex must be expelled for a year. In order to prevent academic regression it was also determined that Rex would serve the term of his expulsion in the Off-Campus DAEP. For the 2010-2011 school year, only 100 days remained in the school year at the time of expulsion. The information on Rex would be reported as follows.
