PEIMS Data Standards 425 DISCIPLINARY ACTION DATA - STUDENTMandatory Expulsion/Non-JJAEP

On June 3, 2011 Rex Learner, who attends a school in a county which is not required to operate a JJAEP, brought a firearm to school in his backpack. Rex is not a special education student. He was immediately suspended out of school for three days. On June 6, 2011, after Rex’s three-day OSS, an expulsion hearing was convened to provide the “due process” requirements for a behavior that requires an expulsion. At the expulsion hearing attended by Rex and his parents, the events of the offense were reviewed and according to the requirements of the law, it was determined that Rex must be expelled for a year. In order to prevent academic regression it was also determined that Rex would serve the term of his expulsion in the Off-Campus DAEP. For the 2010-2011 school year, only 100 days remained in the school year at the time of expulsion. The information on Rex would be reported as follows.

DISCIPLINARY-ACTION-NUMBER 008 is an arbitrary number to distinguish this student’s disciplinary action from this student’s other disciplinary actions.

DISCIPLINARY-ACTION-NUMBER 009 is an arbitrary number to distinguish this student’s disciplinary action from this student’s other disciplinary actions.

DISCIPLINARY-ACTION-REASON-CODE 11 indicates that the cause of the disciplinary action was Use, exhibition, or possession of a firearm - TEC §§37.007(a)(1)(A) and 37.007(e) and/or brought a firearm to school - TEC §37.007(e).

OFFICIAL-LENGTH-OF-DISCIPLINARY-ASSIGNMENT 003 indicates that Rex was given 3 days of OSS.

ACTUAL-LENGTH-OF-DISCIPLINARY-ASSIGNMENT 003 indicates that Rex was actually in OSS for 3 days.

OFFICIAL-LENGTH-OF-DISCIPLINARY-ASSIGNMENT 180 indicates that Rex was given 180 days term of “expulsion with placement to an Off-Campus DAEP”.

REPORTING-INDICATOR-CODE 4 indicates that the disciplinary assignment was made during the first reporting period.

DATE-OF-DISCIPLINARY-ACTION 11032006 indicates that the OSS assignment was ordered on January 3, 2011.

DATE-OF-DISCIPLINARY-ACTION 11062006 indicates that the “expulsion with placement to an Off-Campus DAEP” assignment was ordered on January 6, 2011.

CAMPUS-ID-OF-DISCIPLINARY-RESPONSIBILITY 999999001 indicates that campus 001 is the campus responsible for making the disciplinary assignments and reviewing the placement status of the students while assigned to the DAEP.

During the subsequent school year, the remaining 80 days of “expulsion with placement to an Off-Campus DAEP” will be reported on a 425 Student - Disciplinary Action record using DISCIPLINARY-LENGTH-DIFFERENCE-REASON-CODE 09 to indicate the continuation of a previous year’s disciplinary action assignment. The OFFICIAL-LENGTH-OF-DISCIPLINARY-ASSIGNMENT will be 80, the ACTUAL-LENGTH-OF-DISCIPLINARY-ASSIGNMENT will be 080, and the REPORTING-PERIOD-INDICATOR-CODE will be the reporting period in which the district takes action to continue the prior school year’s expulsion. The DISCIPLINARY-ACTION-CODE will be 04 to indicate that the action taken is a continuation expulsion from the prior school year. The same DISCIPLINARY-ACTION-REASON-CODE 11 is used in the continuation record in the subsequent school year.
